You should inspect any vehicle, arrange your own independent mechanical inspection, and verify registration, finance, and other particulars before purchase. We may obtain vehicle data from third-party sources (including register and history providers). That data can be incomplete, delayed, or inaccurate, and we do not warrant its completeness or correctness.
Risk in a vehicle passes to you on delivery or collection, whichever occurs first, unless a written sale contract says otherwise. Title passes when we have received cleared funds in full (and any trade-in or other conditions are satisfied).
5. Quotes for wrecking, detailing, and towing
Online or verbal quotes for cash-for-cars, wrecking, detailing, towing, or related work are estimates only until we confirm them in writing after assessing the vehicle, location, timing, and scope. We may revise or withdraw a quote if information you provided was incomplete or incorrect, or if circumstances change (including access, condition, or safety).
You warrant that you are entitled to sell or dispose of any vehicle you offer to us, and that it is free of undisclosed encumbrances except as you have told us. You must provide accurate contact and vehicle details.
6. Consumer rights (New Zealand)
If you are a consumer under the Consumer Guarantees Act 1993 or Fair Trading Act 1986, nothing in these Terms limits rights that cannot lawfully be excluded. Where you acquire goods or services for business purposes, the Consumer Guarantees Act is excluded to the maximum extent permitted by law, and our liability is limited as set out below.
7. Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or pure economic loss (including loss of profit, opportunity, or data) arising from the website or our services.
To the maximum extent permitted by law, our aggregate liability to you for all claims arising out of or in connection with the website or any particular transaction or service is limited to the amount you paid us for that transaction or service (or NZD $100 if you paid nothing).
